Waste Producer's Obligations

According to the Environmental Law No. 2872 and the Waste Management Regulation, all institutions, organizations, and businesses that generate waste as a result of their activities are considered “Waste Producers”. Waste producers are responsible for fulfilling the following legal obligations in order to prevent environmental pollution and establish a circular economy:

1. Separation and Storage at Source

  • Correct Classification: Classifying the generated waste correctly according to legal waste codes.
  • Separate Collection: Collecting hazardous, non-hazardous, and recyclable packaging waste separately at the source in designated areas without mixing them.
  • Temporary Storage Area: Establishing a legal "Waste Temporary Storage Area" within the facility boundaries, with a leak-proof floor, fire safety measures in place, and signage.

2. Notification, Declaration and Digital Tracking

  • ECBS Registration: To register with the Integrated Environmental Information System (ECBS) of the Ministry of Environment, Urbanization and Climate Change.
  • Annual Waste Declaration: To declare the amount of waste generated in the previous year completely to the system between the dates determined by the Ministry each year.
  • Mass Balance and MoTAT Tracking: To create a transport form (UATF) via the Mobile Waste Tracking System (MoTAT) for the shipment of hazardous waste.

3. Working with Licensed Companies and Secure Logistics

  • Authorized Transportation and Disposal: To work only with authorized recycling/disposal facilities and licensed logistics companies that have been granted environmental permits and licenses by the Ministry for the transportation and processing of waste.
  • Financial Liability Insurance: To regularly obtain the "Hazardous Materials and Hazardous Waste Financial Liability Insurance" policy, which is legally mandatory for businesses producing hazardous waste, every year.

4. Continuity of Record Keeping and Auditing

  • Document Retention Obligation: To keep waste declaration forms, MoTAT records, and waste receipt documents from licensed facilities (Annex-B / Annex-C) for at least 5 years to be presented during legal audits.
  • Training and Waste Management Plan: To prepare an Industrial Waste Management Plan, have it approved by the Provincial Directorate of Environment, and provide waste management training to personnel.
